01About this policy
Nakama Clothing, operated by FREAK MARKET, SLU, runs this store and website, including all related information, content, features, tools, products and services (the "Services"). The store is powered by Shopify, which enables us to provide the Services to you.
This policy describes how we collect, use and disclose your personal information when you visit, use or buy through the Services, or otherwise communicate with us. If there is a conflict between our terms of service and this policy, this policy controls with respect to your personal information.
By using the Services, you acknowledge that you have read this policy and understand how your information is collected, used and disclosed.
02Personal information we collect
"Personal information" means information that identifies you or can reasonably be linked to you or another person. It does not include anonymous or de-identified information. Depending on how you use the Services, where you live and what the law allows, we may collect:
- Contact details: name, address, billing and shipping address, phone number and email address.
- Financial information: card and financial account details, transaction details, form of payment, payment confirmation and other payment details.
- Account information: username, password, security questions, preferences and settings.
- Transaction information: the items you view, add to your cart or wishlist, buy, return, exchange or cancel, and your past transactions.
- Communications with us: the information you include when you contact us, for example in a customer support request.
- Device information: your device, browser, network connection, IP address and other unique identifiers.
- Usage information: how and when you interact with and navigate the Services.
03Where it comes from
- Directly from you, when you create an account, visit or use the Services, or communicate with us.
- Automatically, from your device when you use the Services, including through cookies and similar technologies.
- From our service providers, when they collect or process personal information on our behalf.
- From our partners or other third parties.
04How we use it
- To provide, tailor and improve the Services: to perform our contract with you, process payments, fulfil orders, arrange shipping, handle returns and exchanges, manage your account, let you post reviews, remember your preferences and recommend products related to your purchases.
- For marketing and advertising: to send promotional communications by email, text message or post, and to show you online advertising based on your purchases, your cart and your activity on the Services.
- For security and fraud prevention: to authenticate your account, keep payments and shopping secure, and detect or act on fraudulent, illegal or malicious activity. If you register an account, keep your credentials safe and do not share them.
- To communicate with you: to give you customer support and keep our relationship with you running smoothly.
- For legal reasons: to comply with the law, respond to valid legal requests, take part in legal proceedings and enforce our terms and policies.
05Who we share it with
- Shopify and service providers that work on our behalf: IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and shipping.
- Business and marketing partners, to provide marketing services and show you advertising. For example, we use Shopify to support personalised advertising with third party services based on your online activity. Those partners use your information under their own privacy notices. Depending on where you live, you can ask us not to share your information for targeted advertising from your privacy choices.
- Third parties you ask us to share with or consent to, for example to ship your order or when you use social media widgets or login integrations.
- Our affiliates or companies within our corporate group.
- Where the law or a business transaction requires it, such as a merger, a court order or a similar request, to enforce our terms or to protect the Services, our rights and the rights of our users.
06Our relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal information about your use of the Services in order to provide and improve them. The information you submit is shared with Shopify and with third parties that may be located outside your country.
We also use some Shopify features that combine information from your interactions with our store, with other merchants and with Shopify. In those cases Shopify is responsible for that processing and for answering your requests about it. You can read more in the Shopify Consumer Privacy Policy and exercise your rights in the Shopify Privacy Portal.
07Third party websites and links
The Services may link to websites and platforms run by third parties. If you follow those links, review their privacy and security policies. We are not responsible for their privacy, security or content, and a link does not mean we endorse them.
Anything you share on public spaces, including third party social networks, may be visible to other users without limitation on how they use it.
08Children
The Services are not intended for children, and we do not knowingly collect personal information from anyone under the age of majority where they live. If you are a parent or guardian and your child has given us personal information, contact us and we will delete it.
We have no actual knowledge that we "share" or "sell" (as defined by applicable law) personal information of people under 16.
09Security and retention
No security measure is perfect, and we cannot guarantee complete security. Information you send us may not be secure while in transit, so please do not use insecure channels to send sensitive or confidential information.
How long we keep your personal information depends on whether we need it to maintain your account, provide the Services, comply with legal obligations, resolve disputes or enforce our contracts and policies.
10Your rights and choices
Depending on where you live, you may have some or all of the following rights. They are not absolute, and in some cases the law allows us to decline a request.
- Access: to ask for the personal information we hold about you.
- Deletion: to ask us to delete your personal information.
- Correction: to ask us to correct inaccurate information.
- Portability: to receive a copy of your information and ask us to transfer it to a third party, in certain circumstances.
- Opting out of sale or sharing for targeted advertising, from your privacy choices. If you visit with the Global Privacy Control signal enabled, we treat it as an opt out request for that device and browser, and for your Shopify account if we can link them. We do not recognise other "Do Not Track" signals.
- Communication preferences: you can unsubscribe from promotional emails at any time with the link in each email. We may still send you emails about your account or your orders.
11Extra rights in the UK and the EEA
If you live in the United Kingdom or the European Economic Area, and subject to local law, you also have the right to:
- Object to or restrict processing of your personal information for certain purposes.
- Withdraw your consent where we rely on it. Withdrawing it does not affect processing carried out before.
You can exercise any of these rights from the Services or by contacting us. We will not discriminate against you for doing so. We may need to verify your identity first, and you may appoint an authorised agent, who will need to prove they act on your behalf. We will answer within the time the law requires.
12Complaints
If you have a complaint about how we process your personal information, contact us first. Depending on where you live, you may appeal our decision or complain to your local data protection authority. In Spain that is the Agencia Española de Protección de Datos, and the list for the whole EEA is published by the European Data Protection Board.
13International transfers
We may transfer, store and process your personal information outside the country where you live.
If we transfer it out of the European Economic Area or the United Kingdom, we rely on recognised transfer mechanisms such as the European Commission's Standard Contractual Clauses or their UK equivalent, unless the destination country has been found to provide an adequate level of protection.
14Changes to this policy
We may update this policy to reflect changes in our practices or for operational, legal or regulatory reasons. We will publish the new version on this page, update the date at the top and give notice where the law requires it.
